When you use this website, personal data will be processed by us, being the data controller, responsible for data processing, and stored for the duration necessary to fulfil the defined purposes and legal obligations. In the following we will inform you about the kind of data that is involved, how it is processed and the rights you are entitled to.


In accordance with Art. 4 No. 1 of the Basic Data Protection Ordinance (DSGVO), personal data is any and all information relating to an identified or identifiable natural person (hereinafter "data subject or user"). We take the security of your data and compliance with data protection regulations seriously. The collection, processing and use of personal data are subject to the provisions of the currently applicable European and national laws.

2. Collection and storage of personal data as well as type, purpose and use

a) When visiting our website

When you visit our website www.knobivital.de, the browser on your device automatically sends information to the server on our website. This information is temporarily stored in a so-called log file. Without your intervention, the following information is recorded and stored within 7 days until automated deletion:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which access is made (referrer URL),
  • Browser type and version as well as
  • other information transmitted by the browser (such as your computer's operating system, the name of your access provider, geographical origin, language setting, etc.).

The mentioned data will be processed by us for the following purposes:

  • to ensure a smooth connection of the website,
  • to ensure comfortable use of our website,
  • to evaluate the system security and stability as well as
  • for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f DSGVO. Our legitimate interest is in line with the purposes listed above for data collection. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you personally.

b) When ordering by telephone

If you order products by contacting us on our telephone number, we collect the following information:

  • Title, first name, surname
  • if available, a valid e-mail address and fax number
  • Address
  • Phone number
  • Date of birth

The collection of this data is made,

  • to be able to identify you as our contractual partner;
  • for order processing;
  • to create a customer profile in our customer database

The data processing is based on your request and is necessary for the fulfilment of the contract and pre-contractual measures according to Art. 6 para. 1 sentence 1 lit. b DSGVO for the purposes mentioned above. By registering in our customer database, you will receive the greatest possible convenience for future orders through a faster and for you easier purchase procedure.

The personal data collected by us for the order will be stored until the expiry of the guarantee period and automatically deleted thereafter, unless we are obliged to store the data for a longer period of time according to Art. 6 para. 1 sentence 1 lit. c DSGVO due to tax and commercial law storage and documentation obligations (from HGB, StGB or AO) or you have agreed to a storage beyond that according to Art. 6 para. 1 sentence 1 lit. a DSGVO.

 

c) When using the call-back service

For questions of any kind, to express product wishes, questions, suggestions or to send positive feedback, we offer you a call-back service. To use the service we require name and surname and your telephone number.

Data for the purpose of contacting us will be processed in accordance with Art. 6 para. 1 sentence 1 lit. f DSGVO on the basis of your voluntary consent.

Personal data collected by us for the purpose of the contact form will be stored in a customer database and deleted after the completion of your request.

 

d) When using the e-mail contact address

You can send general questions to us using the e-mail address on our website. For this purpose we use your e-mail address necessarily, so that we can answer the inquiry.

Additional personal information such as your name, address or telephone number is not recorded unless you provide this information voluntarily. The collection of this data is done in order to know from whom an inquiry originates and to be able to answer it in the way you want (by mail, telephone or e-mail).

Data processing for the purpose of contacting us is based on your voluntarily given consent in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO or on Art. 6 para. 1 lit. b DSGVO or to protect our legitimate interests in accordance with Art. 6 para. 1 lit. f DSGVO. Our legitimate interest is to be able to respond to a customer's enquiries and thus to ensure a functioning customer service.


The personal data collected by us for the use of the contact address will be automatically deleted after your enquiry has been completed.

 

3. Data processing for advertising purposes

a) Postal advertising

In general, we have a legitimate interest in using your data for marketing purposes. We collect the following data for our own marketing purposes:

  • Name
  • Surname
  • Address
  • Year of birth
  • Phone number

The legal basis for this is Art. 6 para. 1 sentence 1 lit. f DSGVO.

We are also authorized to store additional personal data collected about you in compliance with the legal requirements for our own marketing purposes. The aim is to provide you with personalised and relevant advertising and to avoid bothering you with unnecessary advertising.

 

b) Loyalty coupon

Each product box contains a loyalty coupon. When collecting 10 KnobiVital loyalty points, the customer receives a free bottle of his choice. For this purpose, the loyalty points must be returned to us together with a completed loyalty coupon, including the name, address, telephone number and desired type of product. In order to send the free bottle, it is necessary to create a customer account with the personal data you have provided. You will receive information about the created customer account when the free bottle is delivered.

 

4. Transfer of data

Your personal data will not be transferred to third parties for other purposes than those listed below.

 

a) For contract processing

To the extent permitted by law and required under Art. 6 para. 1 sentence 1 lit. b DSGVO for the processing of contractual relationships with you, your personal data will be disclosed to third parties. The data passed on may be used by the third party exclusively for this purpose.

The following data will be transmitted to our shipping service provider DHL Paketdienst in Germany or to Herzog in Austria for the purpose of delivering the ordered products:

  • Name
  • Surname
  • Address
  • Invoice number

 

b) For other purposes

In addition, we only pass on your personal data to third parties if:

  • you have given your express consent in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO,
  • the disclosure pursuant to Art. 6 para. 1 sentence 1 letter f DSGVO is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
  • in the event that there is a legal obligation for disclosure under Art. 6 para. 1 sentence 1 lit. c DSGVO

A transfer of personal data to a third country or an international organisation is excluded.

 

5. Cookies

We use cookies on our site. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do no damage to your end device, and do not contain viruses, Trojans or other malware.

Information is stored in the cookie that results in a connection with the specifically used terminal device in each case. However, this does not mean that we immediately become aware of your identity.

The use of cookies serves to make the use of our offer more pleasant for you. 6. Analysis- and tracking tools

The analysis and tracking measures listed below and used by us are carried out on the basis of Art. 6 para. 1 sentence 1 f DSGVO.

By using analysis and tracking measures, we want to ensure that our website is designed to meet requirements and is continually optimized. Additionally, we use analysis and tracking measures in order to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

The respective data processing purposes and data categories can be found in the corresponding tracking tools.

 

a) Google Analytics

We use Google Analytics, a web analysis service of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter: "Google"). In this context, pseudonymized user profiles are created and cookies are used. The information generated by the cookie about your use of this website such as

  • Browser type/version,
  • Operating system used,
  • Referrer URL (the previously visited page),
  • Host name of the accessing computer (IP address),
  • Time of the server request,

are transferred to a Google server in the USA and stored there. Google complies with the data protection regulations of the EU/US Privacy Shield and is registered with the US Privacy Shield Program of the US Department of Commerce. In addition, we have concluded an order processing agreement with Google for the use of Google Analytics. Through this contract, Google assures that it will process the data in accordance with the basic data protection regulation and guarantees the protection of the rights of the data subject.

The information is used to evaluate the use of the website, to compile reports on the website activities and to provide further services associated with the use of the website and the internet for the purposes of market research and demand-oriented design of these internet pages. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of the company. Under no circumstances will your IP address be merged with other data from Google. The IP addresses are anonymized so that an assignment is not possible (IP masking).

You may refuse the use of cookies by selecting the appropriate settings on your browser. However, we would like to point out that in this case not all features on this website may be used in full.

b) Google AdWords Conversion Tracking

We use Google Conversion Tracking by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter: "Google") on our website in order to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer. Google Adwords sets a cookie on your computer if you have accessed our website via a Google ad.

These cookies expire after 30 days. If the user visits certain pages of the AdWords customer's website and the cookie has not yet expired, Google and the customer can identify that the user has clicked on the ad and has been redirected to this page.

The information generated by the cookie about your use of this website is transferred to a Google server in the USA and stored there. Google complies with the data protection regulations of the "US Privacy Shield" and is registered with the "US Privacy Shield" program of the US Department of Commerce. In addition, we have concluded an order processing agreement with Google for the use of Google AdWords. Through this contract, Google assures that it will process the data in accordance with the basic data protection regulation and guarantees the protection of the rights of the data subject.

Each AdWords customer receives a different cookie. Cookies can therefore not be traced through the websites of AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. We see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they will not receive any information that personally identifies users.

If you do not wish to participate in the tracking process, you can also reject the setting of a cookie required for this – for example using a browser setting that generally deactivates the automatic setting of cookies. You can also deactivate cookies for conversion tracking by setting your browser to block cookies from the "www.googleadservices.com" domain.

c) Google Tag Manager

We also use the Google Tag Manager tool from Google on our website. Google Tag Manager is the tool we use to manage the tools described in this privacy statement. For details on these tools, refer to the information on the specific tool.

The Tool Tag Manager itself (which implements the tags) is a cookieless domain. The tool triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If deactivation has been made at the domain or cookie level, it will remain in effect for all tracking tags implemented with Google Tag Manager.

d) Facebook Pixel

We use the Facebook tracking pixel. The social network Facebook is offered by Facebook Ireland Ltd. With the help of the Facebook pixel we can see how you react to our ads on Facebook, for example when you click on a link in the ad that leads to our website. This gives us a better overview of how successful our campaigns are on Facebook and allows us to continually optimize them.

The pixel-code is loaded onto your device when you respond to an ad we have posted on Facebook, for example, when you click on a link to our site. In this context, a pixel ID is created and stored in a cookie so that we can analyse your user behaviour until the pixel-code expires. The pixel-ID is not used for personal identification.

If you do not want us to analyse your user behaviour in connection with Facebook ads, you can prevent this by making the appropriate cookie setting in your browser. As a user of Facebook, you also have the option to object to the collection of the Facebook pixel in the settings for Facebook advertisements after logging into your account.

As an alternative to opting out in your Facebook account settings, you can prevent collection by Facebook by clicking on this link. An opt-out cookie is set to prevent future collection of your information when you visit this website. The opt-out cookie is valid only in that browser and only for our website and is placed on your device. If you delete the cookies in this browser, you will need to set the opt-out cookie again.

In connection with the use of the Facebook pixel, the collected information is also processed on servers of Facebook Inc. in the USA. Facebook is certified under the US-EU data protection agreement "Privacy Shield" and thus undertakes to comply with the European data protection regulations. These conversion tracking measures are carried out on the basis of Art. 6 para. 1 sentence 1 lit. f DSGVO. We have a legitimate interest in carrying out such measurements in order to optimize our customer approaches in a targeted manner. In this context, user behaviour in connection with marketing measures is recorded and tracked without the identity of the user being immediately disclosed.

 

7. Youtube

We use components (videos) of the company YouTube, LLC 901 Cherry Ave., 94066 San Bruno, CA, USA (hereinafter: "YouTube"), a company of Google Inc., Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter: "Google"), on our Internet pages on the basis of consent pursuant to Art. 6 para. 1 sentence 1 lit. f DSGVO.


In doing so we use the option of the "extended data protection mode" provided by YouTube.


When you access a page that has an embedded video, it connects to the YouTube servers and displays the content on the website by notifying your browser. According to YouTube, your data – in particular which one of our Internet pages you have visited and device-specific information including the IP address – will only be transmitted to the YouTube server in the USA when you watch the Video while in the "extended data protection mode". By clicking on the video, you consent to this transmission. If you are logged in to YouTube at the same time, this information will be associated with your YouTube account. You can prevent this by logging out of your member account before visiting our website.

8. Rights of persons concerned

You have the right:

  • to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if these have not been collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information on their details;
  • to immediately request the correction of incorrect or complete personal data stored by us in accordance with Art. 16 DSGVO;
  • to request the deletion of your personal data stored by us in accordance with Art. 17 DSGVO, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • to restrict the processing of your personal data pursuant to Art. 18 DSGVO, if you dispute the accuracy of the data, if the processing is unlawful but you refuse to delete the data and we no longer need the data, but if you need it to assert, exercise or defend legal claims or if you have filed an objection to the processing pursuant to Art. 21 DSGVO;
  • to receive your personal data that you have provided to us in a structured, current and machine-readable format or to request its transfer to another person pursuant to Art. 20 DSGVO;
  • to revoke your consent to us at any time in accordance with Art. 7 para. 3 DSGVO,. As a result, we are no longer allowed to continue processing data based on this consent in the future and
  • to complain to a supervisory authority pursuant to Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company Headquarters.

 

9. Right of objection

If your personal data are processed on the basis of legitimate interests according to Art. 6 para. 1 lit. e DSGVO (data processing in the public interest) and Art. 6 para. 1 p. 1 lit. f DSGVO (data processing based on a balancing of interests), you have the right to object to the processing of your personal data according to Art. 21 DSGVO, provided that there are reasons for doing so resulting from your particular situation.

If you object, we will no longer process your personal data unless we can demonstrate compelling reasons for processing that are worthy of protection and outweigh your interests, rights and freedoms, or unless the processing serves to assert, exercise or defend legal claims.

If you object to the processing of data for the purpose of direct marketing, we will immediately stop processing. In this case it is not necessary to specify a special situation. This also applies to profiling, insofar as it is connected with such direct marketing.

10. Data security

All data transmitted by you personally is encrypted using the generally accepted and secure standard TLS (Transport Layer Security). TLS is a secure and proven standard that is also used in online banking, for example. You can recognize a secure TLS connection by the ending "s" on http (i.e. https://..) in the address bar of your browser or by the lock symbol at the bottom of your browser.

We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
